The Federal ADA department enforces ADA regulations through complaints, lawsuits, consent decrees, settlement agreements and alternate dispute resolution (mediation).

In general, the ADA regulations cover disability rights concerning hiring practices and accessible design of public buildings and businesses like retail stores and restaurants.

Resolution of a case involving accessibility in a large company can take years to resolve and be very costly.  Keith Austian worked on one case involving a retail chain as an expert witness for over five years to get it resolved.


ADA

 

An ADA violation due to company negligence that contributes to an accident involving injury(s) will increase the cost of the accident.  It will usually increase by 4 to 5 times what it should cost.

The primary Americans with Disabilities (ADA) review areas (modules) covered as part of the ARS Risk Reduction Reviews review include:

HIRING PRACTICES WHICH INCLUDE PHYSICAL DEMAND SCHEDULES FOR JOBS SUCH AS:

·         New Drivers

·         New Maintenance Employees

·         New Production/Employees Employees

.         New Office Employees

PHYSICAL ASPECTS OF BUSINESS SUCH AS:

.           Office buildings

.           Manufacturers

.           Retail Stores

.           Retail Restraints

.           Hotels

.           Transportation (Bus, Trains, etc.)

New review areas (modules) are continously added and so this list may not be complete.

Note:  Only areas a company selects to include are part of a review and new areas can be readily added.

Note:  ADA areas can be added into any of the other Risk Reduction Reviews such as Safety Reviews.
